Twenty-fourth Keynote Speech of the "Fudan TNCs and Law Forum": Illegality (Bribery) in International Business Activities and Compliance

On November 11, 2021, the twenty-fourth keynote speech of the "Fudan Transnational Corporations and Law Forum" was held successfully online. This speech titled "Illegality (Bribery) in International Business Activities and Compliance" was hosted by Dr ZHU Dan, Associate Professor of Fudan University Law School, delivered by Professor WANG Xiumei of Beijing Normal University and commented by Professor WU Yunfeng of East China University of Political Science and Law.

Professor WANG started the speech with multinational business activities of the "Belt and Road" Initiative, which, according to her, has not only led to the rapid global flow of goods, services, capital and technology, but also triggered the accompanying breeding of violations and bribery crimes, especially in international business activities. After briefly introducing common violations and bribery crimes, Professor WANG pointed out that China should not only make continuous improvements at the criminal compliance level, but also address related issues from an administrative or civil law perspective. Then, by making reference to the "long-arm jurisdiction" of the United States, Professor Wang explained certain contradictions presented by relevant cases and possible solutions. Finally, Professor Wang considered that precautions must be taken prior to punishment. The "cleanliness awareness" should be widely disseminated by enterprises to each and every one of theirpersonnel, and enterprises should effectively perform the compliance steps required by international commercial activities. At the same time, seeking a fair and progressive environment for international business activities is not only the goal of enterprises but also the common responsibility and obligation of all countries in the world.

Professor WU Yunfeng spoke highly of Professor WANG's presentation. While highlighting the main points, he put forward a wonderful comment on the possibility of China's judicial improvement space in the face of considerable international commercial activity violations. Scholars and legal professionals who attended the lecture also actively engaged with the discussion. The lecture concluded successfully with a lively discussion.

On November 19, 2021, the Forum will host the twenty-fifth keynote speech, a panel discussion titled "Multinational Companies and Criminal Compliance" and participated by LI Xiang, Professor of East China University of Political Science and Law; LIU Haitao, Senior Partner of King & Wood Mallesons; YU Shengxing, Senior Partner of Hiways Law Firm; and CHEN Dashun, General Counsel for the Asia Pacific Region of PerkinElmer.
