The Tenth Fudan-Konstanz Joint Legal Seminar was Successfully Held in University of Konstanz

This summer witnessed the successful conclusion of the tenth Fudan-Konstanz Joint Legal Seminar which was held in University of Konstanz from July 23rd to 29th, 2018. The teachers and students from University of Konstanz and Fudan University conducted academic conversations and discussions regarding the topic of new legal order in the era of digital market. 

In the first day of the seminar, Prof. Astrid Stadler of University of Konstanz hosted the opening ceremony and warmly welcomed the delegation from Fudan Law School, Whereafter, Prof. CHEN Li, the vice dean of the Fudan Law School, and Prof. JI Ligang delivered welcoming speeches respectively. They highly appreciated the long-established mutual relationship and friendly collaboration maintained by the two universities, which provides favorable platforms for academic communication between Germany and China. Through the annual-routine joint legal seminar, the cooperation has been flourishing among scholars from Fudan and Konstanz academic communities, which promotes the understandings of the both parties towards the legal culture of China and Germany with the perspective of diversification.

The subject of the first session was “Internet Security and Information Protection”, which was hosted by both Professor JI Ligang and Professor Stadler. The teachers and students from University of Konstanz and Fudan University have experienced a heated discussion on the topics of the Protection of Personal Information in Digital Business, the Expansion of EU Data Protection Standards into Third Countries, Justification of The Real-Name System, the Rules of Digital Contract, etc. The judicial practice of digital data protection in Germany arose much more concerns among the scholars in the seminar.

The subject of the second session was “Antitrust Law of China and Germany” , which was hosted by both Prof. CHEN Li and Prof. Jochen Glöckner. In this session, the topics have been discussed on Algorithm-based Dynamic Pricing under European and German Competition Law, Comparative franchise law and practice in EU and China, Practice of Shadow Banking Supervision Between China and Germany, Applicable Law, Consumer Protection and Dispute Resolution of Cross-border Digital Business, etc. Prof. JI Ligang made introduction of the historical evolution, practice development and future expectation of the Shadow Banking Supervision in China. Prof. Stadler and Prof. Glöckner also made some comments and summarizations regarding this issue.

The subject of the third session was “Governance of Emerging Online Environment”, which was hosted by both Prof. Rudolf Rengier and Dr.TU Yunxin. In this session, the topics have been discussed of Crimes in the context of digital markets, Protection of Digital Virtual Property, Intellectual-Property (IP) Infringement Litigations in Digital Era, IA And AI (International Arbitration and Artificial Intelligence) ,the Issue of Air Pollution, etc.

The subject of the fourth session was “Legal Study under the View of Comparative Law”. In this session, Dr. TU Yunxin made a comprehensive speech on the topic of Guiding Cases in Chinese Legal System; Dr. ZHU Dan’s speech focused on the topic of From Tokyo to Rome: China's Approaches towards International Criminal Adjudication; Dr. BAN Tianke analyzed the Mistake in Tax via a Comparative and Flexible-System Approach; Dr. CHEN Li provided a clear introduction on China Cybersecurity and Data Protection Law. Extended discussions have been conducted on the topic of Enforcement of Human Rights via Conflict of Laws, Ecocide as missing fifth crime under international criminal law, Methodology in Comparative Law and so on.

The students participated in this seminar from Fudan University included: FENG Hui (Doctor Candidate), WANG Yiran (Doctor Candidate), PENG Yayuan (Doctor Candidate), CHEN Ziyan (Doctor Candidate), DING Chen(Master Candidate), YI Jiahui(Master Candidate),  LIU Ying(Master Candidate), LIU Miao(Master Candidate), ZHANG Hong(Master Candidate), ZHU Ziwei(Master Candidate), GAO Yuehan(Master Candidate) and WU Qingyao (Bachelor Candidate).

Fudan-Konstanz Joint Legal Seminar is an international exchange program in accordance with the cooperation agreement between Fudan University and University of Konstanz, which is organized by Fudan Law School and Konstanz University School of Law in turn. The seminar had been successfully held for nine times. Fudan Law School organized the seminar in Shanghai in the year of 2005, 2008, 2011, 2014 and 2017, while Konstanz University School of Law organized the seminar in Konstanz in the year of 2006,2009,2012 and 2016. The legal seminar aims to stimulate the graduate students from China and Germany to conduct academic discussions and communications on various fields of law, deepen the understandings of the legal systems of China and Germany, expand their academic horizon and improve the academic exchange between Fudan University and University of Konstanz.
