Fudan Team wins laurels in Intellectual Property Moot Competition

On November 26, 2022, the first ECUPL Intellectual Property Moot hosted by East China University of Political Science and Law (ECUPL) was launched online. Nine teams, including Queen Mary University of London, University of International Business and Economics, Xiangtan University, Jiangsu University, Fudan University, Shanghai Jiao Tong University, Tongji University, Shanghai University of Political Science and Law and East China University of Political Science and Law, were invited to participate in this competition.

The moot competition centered on cutting-edge issues of online game copyright protection. The panel of judges consists of senior judges, officials of international organizations and returnee scholars. The competition is divided into three stages: preliminary round, semi-final round and final round. In the preliminary stage, each school had to play 2 matches (one as Petitioner and another as Respondent), and the opposing schools were decided by drawing lots. In each match, 2 judges will listen to the court and scored the oral arguments of both players. The scores of the two preliminary rounds of oral arguments (70%) plus the scores of the judicial documents (30%) are added to the total score for ranking, and the top 4 teams will advance to the semi-finals. The semi-finals will be heard by 3 judges and the final by 6 judges. The winner will be decided by a vote of the judges in the semi-finals and final.

Fudan team consists of five students: LIN Zhenyu (Master of International Law, Class of 2020), WANG Lyuzhi (Master of International Law, Class of 2021), JIA Mengqi (Master of International Law, Class of 2022), ZHENG Wenlong (undergraduate, Class of 2019), and QIU Kexin (undergraduate, Class of 2020). Among them, LIN Zhenyu and JIA Mengqi are oralists. The team was coordinated by Professor MA Zhongfa and received guidance from Dr. DING Wenjie.

After drawing lots, the team encountered Shanghai Jiao Tong University in the preliminary round (Fudan as Petitioner - Jiao Tong University as Respondent; Jiao Tong University as Petitioner - Fudan as Respondent). Luckily, Fudan team entered the semi-finals with second place overall and competed with the University of International Business and Economics for a place in the finals, while Shanghai Jiao Tong University competed with East China University of Political Science and Law.

In the semi-final stage, Fudan University team bested the position as Respondent. After a fierce courtroom debate, Fudan University team made its way to the final round with a vote of 3:0 by the panel of judges.

In the final round, Fudan University bested the position as Petitioner, and competed for a third time with Shanghai Jiao Tong University team, who defeated ECUPL team in the semi-final round. The final round was scored by a panel of six judges. Excitingly, with a vote of 5:1 by the panel of judges, Fudan team won the championship.
